1. GENERAL PROVISIONS
These general terms and conditions apply to all contractual relationships between the client/customer (hereinafter: “Client”) and the service provider – Ksandarela, Mountain Guiding, Aleksandra Šestir s.p. (hereinafter: “Ksandarela”). They form an integral part of all organized hikes offered by Ksandarela and of various mutually agreed-upon activities.
The terms are an integral part of the offer/contract concluded between Ksandarela and the Client who registers, orders, or pre-books a specific activity or program.
The Client accepts these terms and conditions, which become binding at the moment of reservation or upon participation in an activity without prior reservation. The terms and conditions are available on the website www.ksandarela.com under the link “General Terms and Conditions” and may be amended at any time. If the terms and conditions are amended after a reservation has been made, such amendments do not affect existing contractual relationships between the Client and Ksandarela. Upon the Client’s prior request, Ksandarela may provide the General Terms and Conditions together with its offer/contract.
The Client is deemed to be acquainted with the General Terms and Conditions and to give irrevocable consent thereto when the Client fulfills at least one of the following conditions for an organized hike:
- When the Client reserves a specific activity via the website www.ksandarela.com or via email hello@ksandarela.com and pays the agreed amount;
- When the Client confirms by signed contract that they are acquainted with and irrevocably consent to the general terms and conditions;
- When the Client provides written confirmation of the booking to Ksandarela’s email address;
- When the Client transfers the agreed percentage of the total value of the mutually agreed transaction to Ksandarela’s bank account.
The General Terms and Conditions also include a Liability Waiver, which the Client must review before each organized hike. By signing or making a reservation, the Client confirms acceptance and unconditional agreement, and acknowledges that they will comply with Ksandarela’s rules and instructions during the organized hike. Regardless of whether the Client is an individual participant, company, institution, association, or travel agency, all participants must read and sign the liability waiver.
If any person refuses to sign or disagrees with the instructions, they cannot participate in the hike organized by Ksandarela, regardless of whether the hike was paid in advance or not. Similarly, anyone who does not meet all required regulations may not participate. Signatures may be provided via email or directly at the hike during registration.
2. SERVICES INCLUDED AND NOT INCLUDED IN ORGANIZED HIKES
All services listed in the offer/contract sent to the Client upon registration and confirmed by payment are included in the price of organized hikes.
Services included in Ksandarela’s organized hikes comprise: hike planning with route and stop planning, guided hiking, participant safety assurance, and education regarding mountain culture, nature and its protection, and the code of honor of Slovenian mountaineers.
Other services are services not included in the price of organized hikes but necessary for their execution. These include, for example, accommodation and meals for the guide during multi-day hikes, mileage allowance for the guide to the location of the organized hike, and similar costs. The Client is obligated to cover costs arising from temporary or unforeseen relocation of the guide to the hike location.
Additional costs of an organized hike are costs incurred during the hike itself and include: transportation to the hike location, food and beverages during the hike, and accommodation in mountain huts for multi-day hikes. Additional costs are not included in the hike price and are paid by the Client after prior notification by Ksandarela of the planned starting point and route. Ksandarela reserves the right to recommend licensed transportation providers, visits to mountain farms, and accommodation in mountain huts, which the Client then reserves and pays for independently.
Hidden costs are costs that some companies charge without prior notice to the Client, such as entrance fees, tips, or visits to mountain farms with local products. Ksandarela does not use hidden costs and never charges them to Clients.
3. REGISTRATION/RESERVATIONS AND PAYMENTS
The Client may register or make a reservation via the internet or by email to Ksandarela.
Upon reservation or registration, both parties – Ksandarela and the Client – provide written confirmation of the reservation via email, which constitutes a contract signature and also serves as a reservation confirmation containing details of the organized hike or referencing the hike name where such details are provided.
The Client’s registration/reservation is considered confirmed when Ksandarela accepts it in writing and at least one of the following conditions is met:
FOR INDIVIDUAL HIKE PARTICIPANTS:
- When Ksandarela provides written confirmation to the Client of the desired organized hike name, arrival date, and number of participants from Ksandarela’s email address.
- When the Client reserves and pays for a specific organized hike via Ksandarela’s website, completes the online registration form, and receives confirmation back.
- When the Client sends proof of payment for a pre-determined organized hike via email to Ksandarela.
FOR COMPANIES, INSTITUTIONS, OR ASSOCIATIONS:
- When the Client provides written confirmation of the reservation date to Ksandarela’s email address and simultaneously sends a purchase order as an attachment, based on which Ksandarela issues an invoice to the Client after the organized hike with a specified payment term. The purchase order must contain: the number of persons, the date of the organized hike, and the name of the offer/contract.
- When the responsible person of the company, institution, or association completes the online registration form.
- When the Client transfers the agreed percentage of the total value of the mutually agreed transaction to Ksandarela’s bank account.
FOR TRAVEL AGENCIES:
- When written confirmation (voucher or travel agency purchase order) is provided confirming the desired organized hike name, arrival date, and number of participants to Ksandarela’s email address.
- When the Client pays the percentage specified in the contract required to confirm and reserve the organized hike.
For “Last Minute” offers, the reservation process follows exactly as described above; the only difference is in price. All other provisions and procedures apply equally as described.
4. HIKE PRICES
Prices are listed on the website www.ksandarela.com for each organized hike or on social media.
Registration is valid according to the conditions outlined in Section 3.
Payment must be made via UPN (Unified Payment Notice) to account SI56 2900 0005 3918 859, reference SI99, opened at UniCredit Bank.
On the UPN, please state the purpose of payment: name and surname.
Prices for organized hikes are determined individually. They depend on the content, duration, and difficulty of the organized hike. Financial details for each hike are specified in each individual offer/contract.
Ksandarela reserves the right to change prices by up to 8% per year due to changes in market prices or inflation affecting the price hike. Price increases and decreases are calculated as a percentage equal to the increase or decrease in previously existing prices used in the calculation.
Ksandarela will notify the Client of any price changes at least 20 days before the start of the activity, program, or package. Notification will be provided in writing or verbally. If the price increase exceeds 8%, the Client has the right to terminate the contract without being obligated to reimburse damages or administrative costs, material costs, VAT, or applicable taxes. In this case, Ksandarela refunds the Client the full amount paid for the organized hike.
Any discounts and benefits are mutually exclusive and do not accumulate. If multiple discounts are available, the Client may choose the discount that best suits them at registration.
Ksandarela may propose that, together with another company or agency, the Client pay for services performed on-site in the manner stipulated by the service when Ksandarela acts only as an informant in the sale of services by another company. These are services, activities, or programs that Ksandarela does not directly execute but refers or recommends the Client to another service provider. In such cases, Ksandarela does not act as an organizer or intermediary but solely as an informant. In such cases, the Client addresses any complaints or compensation claims directly to the company, agency, or service provider of the specific service, activity, program, or package.
5. INSTALLMENT PAYMENTS
Further information about installment payment options is available via Ksandarela’s email address. We will inform you of all installment payment options and, upon request, provide an informative calculation. For each change to a reservation, administrative costs of EUR 25 per registration are charged, except in cases where this is already included in the offer.
6. CLIENT’S CANCELLATION OR RESCHEDULING OF ORGANIZED HIKE
The Client has the right to cancel the organized hike at the same location where the reservation was confirmed. Cancellation must be made in writing; otherwise, the cancellation will not be recognized.
If the Client cancels the organized hike, Ksandarela has the right to recover cancellation costs.
The amount of cost recovery depends on when the Client submitted the cancellation. The date of written cancellation is the basis for calculating cancellation fees.
Refunds of the purchase price due to unjustified reasons by the Client are refunded, or Ksandarela retains:
- Up to 21 days before execution: Ksandarela retains or charges 30% of the agreed hike price;
- From 20 to 10 days before execution: Ksandarela retains or charges 50% of the agreed hike price;
- From 9 to 3 days before execution: Ksandarela retains or charges 70% of the agreed hike price;
- From 2 to 0 days before execution: Ksandarela retains or charges 100% of the agreed hike price;
- Non-attendance without cancellation: Ksandarela retains or charges 100% of the agreed hike price.
If cancellation occurs due to justified reasons, the Client must notify Ksandarela immediately, in writing, and within 24 hours of the occurrence of one of the cancellation reasons. When the cancellation reason is serious injury to the Client or deterioration of the health condition of the Client or their family member (close family relationship must be evidenced by appropriate documentation), preventing participation in the organized hike, the Client must provide a certificate from their personal physician. For cancellation due to health reasons, the Client receives:
- 90% of the full remittance for the agreed organized hike, in case of cancellation up to 21 days before the departure date due to serious injury or serious illness, proven by a medical certificate.
- 80% of the full remittance for the agreed organized hike, in case of cancellation from 20 to 10 days before the departure date due to serious injury or serious illness proven by a medical certificate.
- 70% of the full remittance for the agreed organized hike, in case of cancellation from 9 to 3 days before the departure date due to serious injury or serious illness proven by a medical certificate.
- 50% of the full remittance for the agreed organized hike, in case of cancellation up to 2 days before the departure date due to serious injury or serious illness, proven by a medical certificate.
The remainder of the paid remittance remains with Ksandarela to cover registration, administration, and organization costs.
If the number of participants is less than previously agreed upon for the organized hike, the above-mentioned cancellation deadlines apply. If Ksandarela provided the Client with a group discount in the price, such a discount is nullified.
During the course of an organized hike, the Client may, at their own discretion, interrupt the hike. Ksandarela and the Client shall sign a written statement of interruption stating the reason for the interruption. If the Client interrupts the organized hike during execution, they have no right to a refund of costs or purchase price upon return, either partial or full.
After confirming the reservation, the Client may subsequently change or replace the Client’s name or the number of participants. If the Client wishes to increase the number of participants, written confirmation from Ksandarela is required.
If cancellation occurs when the Client is a company, institution, association, or travel agency, the reason for cancellation will be thoroughly investigated.
If it is determined that the Client is unable to participate, the Client and Ksandarela agree on a new date under the same conditions as agreed in the original confirmed reservation. Poor weather forecast is not grounds for cancellation if Ksandarela can ensure safe execution of the organized hike.
If it is determined that cancellation or rescheduling is not justified, Ksandarela issues an invoice to the Client as if the service had been provided.
In case of a new date or rescheduling proposed by Ksandarela, the Client must confirm the new mutually agreed date to Ksandarela in writing within 3 days of Ksandarela sending the new date in writing. In this case, purchase price and costs remain the same as in the original package, taking into account any discounts or price reductions resulting from changed circumstances.
If the Client does not confirm the new agreed date within the agreed timeframe, Ksandarela may release the newly offered date and offer it to other Clients.
If the Client does not accept the proposed rescheduled date of the organized hike, even though an equivalent offer was made, the Client is entitled to a refund of all payments made for the organized hike within 14 days of withdrawal from the contract.
This does not apply in cases where the rescheduling is due to insufficient registrations or force majeure; in such cases, the provisions outlined above shall apply.
To a company, institution, association, or federation that cancels a reserved hike with the first reserved date and does not provide written confirmation of another agreed date, or cancels again, Ksandarela will send an invoice containing all agreed services from the original reservation. The date of written cancellation of the first reservation is the basis for invoice preparation.
7. CANCELLATION OR MODIFICATION OF ORGANIZED HIKE BY KSANDARELA
In accordance with applicable legislation, Ksandarela reserves the right to cancel or modify an organized hike in the following cases:
7a. INSUFFICIENT NUMBER OF REGISTRATIONS:
In case of cancellation by Ksandarela due to insufficient registered participants (if someone cancels after payment until the departure date and the number falls below the minimum), registered participants are entitled to a full refund of the purchase price in accordance with legal timeframes, which Ksandarela will ensure:
- No later than 7 days before the start of activities for hikes longer than 2 days;
- No later than 48 hours before the start of activities for hikes shorter than 2 days.
Ksandarela may charge 10% administrative costs in case of cancellation due to insufficient registrations, where organization costs for hike execution have already been incurred. Participants themselves bear any costs for insurance, visas, vaccinations, etc.
7b. SPECIAL CIRCUMSTANCES OR FORCE MAJEURE (including dangerous weather conditions):
In case of cancellation by Ksandarela due to illness, death in the family, dangerous weather conditions, as well as war or emergency epidemic situations, registered participants are entitled to a full refund of the purchase price in accordance with legal timeframes, which Ksandarela will ensure:
- No later than 7 days before the start of activities for hikes longer than 2 days;
- No later than 48 hours before the start of activities for hikes shorter than 2 days.
Ksandarela may charge 10% administrative costs in case of cancellation due to special circumstances or force majeure, where organization costs for hike execution have already been incurred. Participants themselves bear any costs for insurance, visas, vaccinations, etc.
7c. EXTRAORDINARY CIRCUMSTANCES DURING EXECUTION OF ORGANIZED HIKE:
During the execution of an activity, Ksandarela reserves the right to fully or partially withdraw from the organized hike if extraordinary circumstances arise during the hike that could not have been foreseen, eliminated, or avoided, and which constitute justified grounds for Ksandarela not to confirm the reservation had such information existed at the time of contract conclusion. In this case, Ksandarela does not refund the paid purchase price.
Ksandarela reserves the right to fully or partially withdraw from the organized hike if, before or during the hike, one or more Clients or their guests directly violate the provisions stated in the General Terms and Conditions and the Liability Waiver. In this case, Ksandarela does not refund the paid purchase price.
Ksandarela reserves the right to fully or partially withdraw from the organized hike if, before or during the hike, the mountain guide working and acting on behalf of Ksandarela determines that a particular participant is not physically and/or psychologically capable of the exertion required by the hike and would endanger their own or others’ health or life by continuing, this could not have been detected before the start, and the Client did not inform Ksandarela of this. In this case, Ksandarela does not refund the paid purchase price.
Ksandarela is entitled to recover damages incurred if damages result from a violation of the hike participant rules.
7d. RESCHEDULING OF PREPAID HIKE:
For a new date/rescheduling proposed by Ksandarela, the Client must confirm the new mutually agreed date to Ksandarela within 3 days of Ksandarela sending the new date in writing. In this case, the purchase price and costs are the same as the previous offer, with consideration for any discounts or price reductions due to changed circumstances.
If the Client does not confirm the new agreed date within the agreed timeframe, Ksandarela may release the newly offered date and offer it to other Clients.
If the Client does not accept the rescheduled date of the hike, even though an equivalent offer was made, the Client is entitled to a refund of all payments made for the organized hike within 14 days of withdrawal from the contract.
This does not apply in cases where the rescheduling is due to insufficient registrations or force majeure; in such cases, the provisions outlined above shall apply.
8. PARTICIPANT SAFETY AND LIABILITY WAIVER
A brief overview of responsibility and co-responsibility guidelines for organized hikes, which every participant must sign when completing the registration form for a specific hike:
Participants are expected to be in good physical and mental health and not under the influence of alcohol or other psychoactive substances.
All participants must be adults; minors must be accompanied by an adult or have a certificate from parents or guardians confirming permission to participate, and must accept responsibility and co-responsibility during the organized hike.
LIMITATIONS FOR PARTICIPATION IN ORGANIZED HIKES:
For each hike, the above limitations apply. Additionally, specific provisions regarding the number of participants and age limitations are stated for each hike on the website and in the hike instructions sent to participants after registration.
Ksandarela reserves the right to impose additional limitations due to extraordinary weather conditions.
Ksandarela advises against participation by pregnant women and persons with serious health conditions or injuries.
In case of poor weather or other extraordinary circumstances, Ksandarela reserves the right to cancel or interrupt the activity at any time. Upon cancellation, the Client will receive a refund of reservation costs in accordance with the provisions of these terms and conditions, unless otherwise specified for a particular hike in the registration form.
Responsibility for rescheduling hikes due to poor weather conditions rests exclusively with Ksandarela. Lay opinions of participants are not considered and are not grounds for tour cancellation.
Ksandarela is not responsible for injuries occurring outside the course of the organized hike.
Ksandarela is not responsible for injuries that occurred in violation of the stated provisions or due to non-compliance with instructions from Ksandarela’s mountain guides.
Anyone with any health conditions must notify the mountain guide of this before the start of the hike.
Injuries occurring during the hike must be reported immediately to the mountain guide. Ksandarela will not consider any injuries reported subsequently.
An organized hike is led exclusively by a properly trained guide with appropriate and valid licenses.
The equipment participants must have is the equipment listed on the website or social media, or equipment recommended by the guide and provided in writing to registered participants, including photographic materials if necessary.
In case of any emergency, the guest allows the hike guide to arrange appropriate medical care.
Participants must have health and accident insurance.
Participants must be insured for rescue from mountains in Slovenia and abroad.
Ksandarela photographs all hike participants and reserves the right to use photographs for marketing purposes. Photographs taken during the hike execution are the property of Ksandarela.
Exceptions are persons who indicate in advance on the registration form that they do not permit the use of photographs. They must inform the guide of this before the hike begins.
Ksandarela assumes no responsibility for lost, stolen, or damaged personal belongings.
LIABILITY WAIVER:
By signing the submitted registration form, each participant guarantees that, in full awareness and responsibility and without coercion, they confirm that they have been informed about Ksandarela’s organized hikes:
- that the hike may be physically demanding and is being undertaken of their own volition;
- that the hike is not being undertaken under the influence of alcohol, drugs, or other psychoactive substances;
- that the hike is not being undertaken for recovery from serious physical injuries (knee, spine, hip, shoulder surgery, heart surgery, etc.) without prior recommendation from a personal physician;
- that they are familiar with the manner of hike execution and will execute it according to the guide’s instructions and Ksandarela’s internal rules, which they have read before signing this statement or which were explained before and during the hike;
- that in case of injuries and their consequences, they will not personally or through third parties lodge claims against Ksandarela or individual guides due to their own negligence and thereby cause injuries to themselves or other participants.
In case of any characteristic or health-related particularity, the participant must state this in the registration form; otherwise, Ksandarela will consider that there are no health conditions.
If the participant has chronic illnesses or other serious forms of health conditions, they must consult with a physician regarding the organized hike and submit a medical certificate to Ksandarela’s email address before the hike execution, which will serve as permission to conduct the hike.
9. DATA USAGE
Ksandarela protects all data obtained about the Client in accordance with the Personal Data Protection Act (Official Gazette of the Republic of Slovenia, No. 163/22 and 40/25, hereinafter: PDPA and LFIS-1). When the Client confirms the reservation, they are deemed to consent to the use of this data for purposes of statistical processing, market research, customer segmentation, and informing them about offers. If the Client does not wish this, they may state so at the reservation or at any later time.
10. COMPLAINTS AND CLAIMS
The Client must raise any irregularities or deficiencies with the hike guide or direct service provider on-site.
If the cause of the complaint cannot be resolved on-site, the Client shall prepare a written statement or complaint form with the direct service provider or hike guide, which shall be signed by the service provider representative or service executor and the affected Client. The complaint record also serves as official documentation that the Client raised the complaint on-site.
The complaint must be substantiated. The Client should therefore submit appropriate evidence and/or appropriate confirmation from the guide or other appropriate persons regarding the actual situation on which the Client bases their claim, and if related to an offer sold by Ksandarela.
Ksandarela is obligated to provide a written response to the Client for the first time within 8 days of receiving the complaint, and finally within a reasonable timeframe necessary to obtain information about the cause of the complaint from the service provider or within the time necessary to obtain information from third parties in accordance with Article 893 of the Law on Obligations. Until Ksandarela issues a response, the Client forfeits submission of the complaint to any other person or judicial institutions or provision of information to the media and other public entities.
Ksandarela will only address complaints where the cause could not be resolved on-site.
11. HEALTH REGULATIONS
The Client is co-responsible and assures Ksandarela that none of the organized hike participants have any health reservations or limitations for the hike execution before arriving at the hike. The Client is aware that all organized hikes executed by Ksandarela carry an increased risk factor for injuries and other dangers, and therefore, organized hikes are in no way suitable for pregnant women and persons with various back injuries, those who have suffered other serious injuries or undergone operations, and prior consultation with a physician is necessary. Similarly, organized hikes are not suitable for persons with elevated blood pressure and those with heart conditions. Anyone with any health conditions is responsible for informing Ksandarela already at the time of reservation; if this is not possible, then at the latest before the start of any organized hike.
Terms for cancellation by the Client due to illness are defined in Section 6 of these General Terms and Conditions.
12. ACTIVITIES OR SERVICES WHERE KSANDARELA IS NOT THE ORGANIZER
Where Ksandarela is not the organizer of an activity or service, it acts in the role of informant. In such cases, it provides information received from the organizer and/or activity or service provider to the Client and assists the Client in registering for the activity or service. Conditions for registration, payment, and possible cancellation of the activity or service are in accordance with the valid conditions of the other organizer or service provider. The Client resolves any complaints with the organizer or service provider of the activity or service.
13. FINAL PROVISIONS
All prices for organized hikes in Ksandarela’s offers include Value Added Tax. Prices prepared for individual offers already include Value Added Tax. In case of dispute between the parties, the district court has jurisdiction over all disputes. These general terms and conditions apply to all offers/contracts concluded as of the date of publication on the website www.ksandarela.com, where all amendments are regularly updated.

1. SPLOŠNA DOLOČILA
Splošni pogoji veljajo za vsa razmerja med stranko – naročnikom in izvajalcem – podjetjem Ksandarela, planinsko vodenje, Aleksandra Šestir s.p. (v nadaljevanju: Ksandarela) in so sestavni del vseh organiziranih pohodov podjetja Ksandarela ter različnih medsebojnih in vnaprej dogovorjenih aktivnosti. So pripadajoči del ponudbe/pogodbe, ki jo skleneta podjetje Ksandarela in stranka, ki se prijavlja oziroma naroča in vnaprej rezervira določeno aktivnost ali program.
Stranka sprejme te pogoje in jo zavezujejo v trenutku rezervacije ali ob sodelovanju v aktivnosti brez predhodne rezervacije. Pogoji so dostopni na spletni strani www.ksandarela.com na povezavi Splošni pogoji poslovanja in se lahko kadarkoli spremenijo. Če se pogoji spremenijo po opravljeni rezervaciji, to ne vpliva na že obstoječe razmerje med stranko in podjetjem Ksandarela. Na predhodno željo naročnika lahko pri oddaji oziroma posredovanju ponudbe/pogodbe podjetja Ksandarela stranki k ponudbi/pogodbi doda tudi Splošne pogoje poslovanja.
Da je naročnik seznanjen s Splošnimi pogoji poslovanja in daje nepreklicno soglasje
k le-tem, se šteje, ko naročnik izpolni vsaj enega od navedenih pogojev za organizirani pohod:
- Ko rezervira določeno aktivnost preko spletne strani www.ksandarela.com ali na elektronski naslov hello@ksandarela.com in vplača dogovorjen znesek;
- Ko s podpisom medsebojne pogodbe potrjuje, da je seznanjen s splošnimi pogoji poslovanja ter da z njimi nepreklicno soglaša;
- Ko pisno potrdi naročilo organiziranega pohoda na elektronski naslov podjetja Ksandarela;
- Ko na tekoči račun podjetja Ksandarela nakaže dogovorjen odstotek vrednosti vnaprej dogovorjenega medsebojnega posla.
Splošni pogoji poslovanja vsebujejo tudi Izjavo o odgovornosti, s katero se naročnik
pred začetkom vsakega organiziranega pohoda seznani, s podpisom/rezervacijo pa potrdi, da se strinja in neizpodbitno soglaša ter potrjuje, da bo upošteval pravila in navodila podjetja Ksandarela med izvajanjem organiziranega pohoda. Ne glede na to, ali je naročnik individualni udeleženec, podjetje, zavod, društvo ali agencija, morajo izjavo prebrati in podpisati vsi udeleženci, ki se bodo določenega organiziranega pohoda udeležili.
Če posameznik ali več njih ne želi podpisati ali se ne strinja z navodili, se poohoda v organizaciji podjetja Ksandarela ne more udeležiti, in to ne glede na to, ali je bil organiziran pohod plačan vnaprej ali ne. Ravno tako se pohoda ne morejo udeležiti vsi tisti, ki ne izpolnjujejo vseh zahtevanih predpisov. Velja podpis preko elektronske pošte ali direktno na pohodu pri prijavi na samo dejavnost.
2. STORITVE, KI SO IN KI NISO VŠTETE V ORGANIZIRANE POHODE PODJETJA KSANDARELA
V ceno organiziranih pohodov so vštete vse storitve, ki so navedene v ponudbi / pogodbi, ki je bila ob oddani prijavnici poslana naročniku in jo je s plačilom potrdil. Storitve, vključene v organizirane pohode podjetja Ksandarela, zajemajo načrtovanje pohoda z načrtom poti in postankov na poti, vodenje pohoda, skrb za varnost udeležencev pohoda, ter seznanjanje udeležencev pohoda z gorsko kulturo, naravo in njenim varovanjem, ter s častnim kodeksom slovenskih planincev.
Druge storitve so storitve, ki niso vključene v ceno organiziranih pohodov, so pa nujno potrebne za njihovo izvedbo. Sem sodijo na primer nočitve in prehrana vodnika pri večdnevnih organiziranih pohodih, kilometrina vodnika do lokacije izvajanja organiziranega pohoda, ter drugi podobni stroški. Naročnik je dolžan poravnati tudi stroške, ki nastanejo zaradi začasne ali nepredvidene premestitve vodnika na lokacijo izvajanja organiziranega pohoda.
Dodatni stroški organiziranega pohoda so stroški, ki nastanejo na pohodu samem, in vključujejo prevoz na lokacijo izvajanja organiziranega pohoda, prehrano in pijačo na pohodu samem, ter nastanitve v planinskih kočah pri več-dnevnih organiziranih pohodih. Dodatni stroški niso vključeni v ceno organiziranega pohoda in jih naročnik poravna sam, ob predhodnem obvestilu podjetja Ksandarela o načrtovanem izhodišču in načrtovani poti organiziranega pohoda. Podjetje Ksandarela si pridržuje pravico do priporočil za najem licenciranih prevoznikov, obisk planinskih kmetij ter prenočitev v planinskih kočah, ki jih naročnik potem sam rezervira in plača.
Skriti stroški so stroški, ki jih nekatera podjetja zaračunavajo brez predhodnega obvestila naročniku, kot so na primer različne vstopnine, napitnine ali obiski planinskih kmetij z lokalnimi izdelki. Podjetje Ksandarela skritih stroškov ne uporablja in jih naročnikom nikoli ne zaračunava.
3. PRIJAVE / REZERVACIJE IN VPLAČILA
Naročnik se lahko prijavi oziroma izvede rezervacijo preko interneta ali po elektronski pošti podjetja Ksandarela.
Ob rezervaciji oziroma prijavi obe strani, tako podjetje Ksandarela kot tudi naročnik, pisno potrdita rezervacijo preko emaila, kar se smatra za podpis pogodbe in je hkrati tudi potrdilo o rezervaciji ter vsebuje podatke o organiziranem pohodu, na katerega se je naročnik prijavil, ali pa se sklicuje na ime pohoda, kjer so ti podatki navedeni.
Naročnikova prijava / rezervacija velja za potrjeno, ko jo pisno sprejme podjetje Ksandarela in je hkrati izpolnjen vsaj eden od spodaj navedenih pogojev:
INDIVIDUALNI UDELEŽENEC POHODA:
- Ko podjetje Ksandarela naročniku pisno potrdi ime želenega organiziranega pohoda, datum prihoda in število udeležencev iz elektronskega naslova podjetja Ksandarela.
- Ko naročnik rezervira in vplača določen organiziran pohod preko spletne strani podjetja Ksandarela, ko izpolni spletno prijavnico in dobi potrjeno rezervacijo nazaj.
- Ko naročnik po elektronski pošti pošlje potrdilo o plačilu za vnaprej določen organiziran pohod podjetja Ksandarela.
PODJETJE, ZAVOD ali DRUŠTVO:
- Ko na elektronski naslov podjetja Ksandarela pisno potrdi datum rezervacije in hkrati v priponki pošlje naročilnico, na podlagi katere podjetje Ksandarela po izvedbi organiziranega pohoda naročniku izda račun z določeno valuto dni. Naročilnica vsebuje naslednje podatke: število oseb, datum organiziranega pohoda in ime ponudbe/pogodbe.
- Ko izpolne spletno prijavnico odgovorna oseba podjetja, zavoda ali društva.
- Ko na tekoči račun podjetja Ksandarela nakaže dogovorjen odstotek celotne vrednosti vnaprej dogovorjenega medsebojnega posla.
TURISTIČNA AGENCIJA:
- Ko s pisnim potrdilom (vavčer ali naročilnica agencije) potrdi ime želenega organiziranega pohoda, datum prihoda in število udeležencev na elektronski naslov podjetja Ksandarela.
- Ko vplača v pogodbi določen odstotek, ki je potreben za potrditev in rezervacijo organiziranega pohoda.
Če gre za “Last minute” ponudbo, rezervacija poteka natanko po vseh opisih, navedenih zgoraj; edina razlika je v ceni. Vse ostale določbe in postopki veljajo enako kot opisano.
4. CENE ORGANIZIRANIH POHODOV
Cena je podana na spletni strani www.ksandarela.com pri vsakem organizranem pohodu ali na socialnih omrežjih.
Prijava je veljavna po pogojih, navedenih v 3. točki.
Plačilo je potrebno poravnati preko UPN na TRR SI56 2900 0005 3918 859, sklic SI99, odprt pri Unicredit banki.
Na UPN napišite namen plačila: ime in priimek.
Cene organiziranih pohodov se določajo posamično. Odvisne so od vsebine, trajanja in zahtevnosti organiziranega pohoda. Finančno so organizirani pohodi razdelani v vsaki ponudbi / pogodbi posebej.
Podjetje Ksandarela si pridržuje pravico do spremembe cene, do 8% na leto, ki bi lahko nastala zaradi sprememb cen na trgu ali inflacije, ki vplivajo na postavitev cene organiziranega pohoda. Zvišanje in znižanje cene se obračuna z odstotkom, enakim povečanju ali zmanjšanju predhodno obstoječih cen, ki so bile upoštevane v kalkulaciji.
O morebitni spremembi cene organiziranega pohoda podjetje Ksandarela naročnika obvesti najmanj 20 dni pred začetkom aktivnosti, programa ali paketa. Naročnika se obvesti pisno ali ustno. Če podražitev preseže 8% odstotkov, ima naročnik pravico razdreti pogodbo, ne da bi moral povrniti škodo oz. stroške za administracijo, materialne stroške, DDV oz. morebitne takse. V tem primeru podjetje Ksandarela naročniku povrne vplačan celotni znesek organiziranega pohoda.
Morebitni popusti in ugodnosti se izključujejo ter se ne seštevajo. Če je predvidenih več popustov, si lahko naročnik ob prijavi zbere tisti popust, ki mu najbolj ustreza.
Podjetje Ksandarela lahko za določeno storitev predlaga skupaj z drugim podjetjem ali agencijo, da naročnik plača storitve, ki bodo opravljene na kraju samem in na način, kot ga predvideva storitev v primeru, da je podjetje Ksandarela samo informator pri prodaji storitev drugega podjetja. Tu gre za storitve, aktivnosti ali programe, ki jih podjetje Ksandarela ne izvaja neposredno, temveč naročnika napoti / predlaga k drugemu izvajalcu. V tem primeru podjetje Ksandarela ne nastopa kot organizator in ne kot posrednik, temveč zgolj kot informator. V tem primeru naročnik vse reklamacijske in odškodninske zahtevke uveljavlja na kraju samem pri podjetju, agenciji oziroma izvajalcu določene storitve, aktivnosti, programa ali paketa.
5. PLAČILA NA OBROKE
Več informacij o možnosti plačila na obroke je na voljo preko elektronskega naslova podjetja Ksandarela. Tam vas bomo seznanili z vsemi možnostmi obročnih odplačevanj in vam po želji pripravili informativni izračun. Za vsako spremembo rezervacije se zaračunajo administrativni stroški v višini 25 EUR na prijavnico, razen v primerih kjer je to že vključeno v ponudbo.
6. NAROČNIKOVA ODPOVED ALI PRESTAVITEV ORGANIZIRANEGA POHODA
Naročnik ima pravico do odpovedi organiziranega pohoda, in sicer na istem mestu, kot je rezervacijo potrdil. Odpoved mora biti obvezno v pisni obliki, sicer se odpoved organiziranega pohoda ne upošteva.
Če naročnik odpove organizirani pohod, ima podjetje Ksandarela pravico do povračila stroškov zaradi odpovedi organiziranega pohoda.
Višina povračila stroškov je odvisna od časa, v katerem je naročnik predložil odpoved. Datum pisne odpovedi je osnova za obračun stroškov stornacije.
Vračilo kupnine zaradi neutemeljenih razlogov naročnika se vrača oz. podjetje Ksandarela zadrži:
- do 21 dni pred izvedbo organiziranega pohoda podjetje Ksandarela zadrži oziroma zaračuna 30 % dogovorjene cene organiziranega pohoda;
- od 20 do 10 dni pred izvedbo organiziranega pohoda podjetje Ksandarela zadrži oziroma zaračuna 50 % dogovorjene cene organiziranega pohoda;
- od 9 do 3 dni pred izvedbo organiziranega pohoda podjetje Ksandarela zadrži oziroma zaračuna 70 % dogovorjene cene organiziranega pohoda;
- od 2 do 0 dni pred izvedbo organiziranega pohoda podjetje Ksandarela zadrži oziroma zaračuna 100 % dogovorjene cene organiziranega pohoda;
Neudeležba brez odpovedi – podjetje Ksandarela zadrži oziroma zaračuna 100 % dogovorjene cene organiziranega pohoda.
Če pride do odpovedi rezervacije zaradi utemeljenih razlogov, mora naročnik to podjetju Ksandarela javiti takoj, in to obvezno v pisni obliki in v 24 urah od nastanka enega od vzrokov odpovedi. Kadar je razlog za odpoved huda poškodba naročnika ali poslabšanje zdravstvenega stanja naročnika ali njegovega svojca (ožje sorodstveno razmerje mora biti razvidno iz ustreznega dokumenta), ki naročniku onemogoča udeležbo na organiziranem pohodu, mora predložiti potrdilo osebnega zdravnika. Za odpoved iz zdravstvenih razlogov se naročniku povrne:
- 90% celotnega nakazila za dogovorjen organiziran pohod, v primeru odpovedi udeleženca do 21 dni pred datumom odhoda zaradi hude poškodbe ali resnega bolezenskega stanja, ki ga dokaže z zdravniškim opravičilom.
- 80% celotnega nakazila za dogovorjen organiziran pohod, v primeru odpovedi udeleženca od 20 do 10 dni pred datumom odhoda zaradi hude poškodbe ali resnega bolezenskega stanja, ki ga dokaže z zdravniškim opravičilom.
- 70% celotnega nakazila za dogovorjen organiziran pohod, v primeru odpovedi udeleženca od 9 do 3 dni pred datumom odhoda zaradi hude poškodbe ali resnega bolezenskega stanja, ki ga dokaže z zdravniškim opravičilom.
- 50% celotnega nakazila za dogovorjen organiziran pohod, v primeru odpovedi udeleženca do 2 dni pred datumom odhoda zaradi hude poškodbe ali resnega bolezenskega stanja, ki ga dokaže z zdravniškim opravičilom.
Preostanek vplačanega nakazila ostane podjetju Ksandarela zaradi stroškov prijave, administracije in organizacije.
Pri manjšem številu udeležencev, kot je bilo predhodno dogovorjeno za organizirani pohod, se upošteva zgoraj napisane odpovedne roke za organiziran pohod. Če je podjetje Ksandarela naročniku pri ceni upoštevalo skupinski popust, se ta izniči.
Med trajanjem organiziranega pohoda lahko naročnik na svojo željo prekine pohod. Podjetje Ksandarela in naročnik podpišeta pisno izjavo o prekinitvi, v kateri se navede razlog prekinitve. Če naročnik organiziran pohod prekine med samim izvajanjem, ob vrnitvi nima pravice do povračila stroškov ali kupnine, ne delno ne v celoti.
Naročnik lahko naknadno po potrditvi rezervacije spremeni oziroma zamenja ime naročnika ali število udeležencev. Če želi naročnik število udeležencev povečati, je za to potrebno pisno potrdilo podjetja Ksandarela.
Če pride do odpovedi organiziranega pohoda, ko je naročnik podjetje, zavod, društvo ali turistična agencija, se temeljito preveri razlog odpovedi.
Če se ugotovi, da naročnik nima možnosti udeležbe, se naročnik in podjetje Ksandarela dogovorita za nov termin pod enakimi pogoji, kot so bili dogovorjeni ob prvi potrjeni rezervaciji. Napoved slabega vremena ni razlog za odpoved, če lahko podjetje Ksandarela naročniku zagotovi varno izvedbo organiziranega pohoda.
Če se ugotovi, da odpoved ali prestavitev ni upravičena, podjetje Ksandarela izda račun naročniku enako kot za opravljeno storitev.
V primeru novega termina oziroma prestavitve, ki jo predlaga podjetje Ksandarela, mora naročnik v roku 3 dni od dneva, ko mu podjetje Ksandarela pisno posreduje nov, medsebojno dogovorjen termin, tega pisno potrditi. V tem primeru ostaneta kupnina in stroški enaki kot pri prvotnem paketu, pri čemer se upoštevajo tudi morebitni popusti ali znižanja cen, ki izhajajo iz spremenjenih okoliščin.
Če naročnik v dogovorjenem času ne potrdi novega dogovorjenega termina, lahko podjetje Ksandarela nov ponujen termin ponovno sprosti in ga ponuja drugim naročnikom.
V primeru, da naročnik ne sprejme ponujene prestavitve termina organiziranega pohoda, kljub temu da mu je bil ponujena enakovredna ponudba, je upravičen do vračila vseh plačil, ki jih je za organiziran pohod vplačal, in sicer v roku 14 dni od odstopa od pogodbe.
Navedeno ne velja v primerih, ko je prestavitev termina posledica premajhnega števila prijav ali višje sile; v teh primerih se ravna skladno z določbami, navedenimi v zgornjih točkah.
Podjetju, zavodu, društvu ali zvezi, ki odpove rezerviran pohod s prvim terminom rezervacije in drugega dogovorjenega termina pisno ne potrdi oziroma ga ponovno odpove, podjetje Ksandarela pošlje račun, ki vsebuje vse dogovorjene storitve na prvotno dogovorjeni rezervaciji. Datum pisne odpovedi prve rezervacije je osnova za sestavo računa.
7. ODPOVED ALI SPREMEMBA ORGANIZIRANEGA POHODA S STRANI PODJETJA KSANDARELA
Podjetje Ksandarela si skladno z veljavno zakonodajo pridržuje pravico do odpovedi ali spremembe organiziranega pohoda v naslednjih primerih:
7a. Premajhno število prijavljenih oseb:
V primeru odpovedi iz strani podjetja Ksandarela zaradi premalo prijavljenih udeležencev (od minimalnega števila udeležencev se še nekdo v času po plačilu do datuma odhoda oz. izvedbe odjavi) so prijavljeni udeleženci upravičeni do povračila vse kupnine v skladu z zakonskimi roki, za katere poskrbi glede odpovedi podjetje Ksandarela, in sicer:
- najkasneje do 7 dni pred začetkom aktivnosti za pohode, daljše od 2 dni;
- najkasneje do 48 ur pred začetkom aktivnosti za pohode, krajše od 2 dni.
Podjetje Ksandarela lahko v primeru odpovedi zaradi premajhnega števila prijav zaračuna 10 % administrativnih stroškov, kjer so bili že plačani stroški organizacije za izvedbo pohoda. Udeleženec sam nosi morebitne stroške zavarovanj, vizumov, cepljenj ipd…
7b. Posebne okoliščine ali višja sila (tudi nevarne vremenske razmere):
V primeru odpovedi iz strani podjetja Ksandarela zaradi bolezni, smrti v družini, nevarnih vremenskih razmer, prav tako tudi zaradi vojnega stanja ali izrednega stanja epidemije, so prijavljeni udeleženci upravičeni do povračila vse kupnine v skladu z zakonskimi roki, za katere poskrbi glede odpovedi podjetje Ksandarela, in sicer:
- najkasneje do 7 dni pred začetkom aktivnosti za pohode, daljše od 2 dni;
- najkasneje do 48 ur pred začetkom aktivnosti za pohode, krajše od 2 dni.
Podjetje Ksandarela lahko v primeru odpovedi zaradi posebnih okoliščin ali višje sile zaračuna 10 % administrativnih stroškov, kjer so bili že plačani stroški organizacije za izvedbo pohoda. Udeleženec sam nosi morebitne stroške zavarovanj, vizumov, cepljenj ipd…
7c. Izredne okoliščine med izvedbo organiziranega pohoda
Med izvajanjem aktivnosti si podjetje Ksandarela pridržuje pravico do popolnega ali delnega odstopa od organiziranega pohoda, če med izvajanjem pohoda nastopijo izredne okoliščine, ki jih ni bilo mogoče pričakovati, odstraniti ali se jim izogniti, za podjetje Ksandarela pa te okoliščine pomenijo utemeljen razlog, da rezervacije predhodno ne bi potrdila, če bi ob sklenitvi pogodbe obstajale informacije o izrednih okoliščinah. V tem primeru podjetje Ksandarela ne vrača že vplačane kupnine.
Podjetje Ksandarela si pridržuje pravico do popolnega ali delnega odstopa od organiziranega pohoda, če pred ali med izvajanjem pohoda eden ali več naročnikov ali naročnikovih gostov neposredno krši določbe, ki so zapisane v Splošnih pogojih in Izjavi o odgovornosti. V tem primeru podjetje Ksandarela ne vrača že vplačane kupnine.
Podjetje Ksandarela si pridržuje pravico do popolnega ali delnega odstopa od organiziranega pohoda, če pred ali med izvajanjem pohoda planinski vodnik, ki dela in nastopa v imenu podjetja Ksandarela, ugotovi, da določeni udeleženec na določenem pohodu ni fizično in/ali psihično sposoben napora, ki ga od njega zahteva pohod, in bi z nadaljevanjem pohoda ogrožal svoje in tuje zdravje ali življenje, pred začetkom pohoda tega ni bilo mogoče opaziti ali zaznati, naročnik pa podjetja Ksandarela o tem ni obvestil. V tem primeru podjetje Ksandarela ne vrača že vplačane kupnine.
Podjetje Ksandarela je upravičeno do povračila nastale škode v primeru, da zaradi kršenja pravil udeležencev pohoda, do škode tudi pride.
7d. Sprememba termina že vplačanega pohoda
Pri novem terminu / prestavitvi, ki jo ponudi podjetje Ksandarela, mora naročnik potrditi nov medsebojno dogovorjen termin podjetju Ksandarela v roku 3 dni od dne, ko je podjetje Ksandarela pisno poslalo naročniku nov medsebojno dogovorjeni datum. V tem primeru so kupnina in stroški enaki prejšnji ponudbi, upošteva se tudi morebitne popuste ali znižanja cen zaradi spremembe okoliščin.
Če naročnik v dogovorjenem času ne potrdi novega dogovorjenega termina, lahko podjetje Ksandarela nov ponujen termin ponovno sprosti in ga ponuja drugim naročnikom.
V primeru, da naročnik ne sprejme prestavitve termina pohoda, kljub temu da mu je bil ponujena enakovredna ponudba, je upravičen do vračila vseh plačil, ki jih je za organiziran pohod vplačal, in sicer v roku 14 dni od odstopa od pogodbe.
Navedeno ne velja v primerih, ko je prestavitev termina posledica premajhnega števila prijav ali višje sile; v teh primerih se ravna skladno z določbami, navedenimi v zgornjih točkah.
8. VARNOST UDELEŽENCEV NA POHODIH ter IZJAVA O ODGOVORNOSTI
Kratek pregled navodil o odgovornosti in soodgovornosti pri organiziranih pohodih, ki jih podpiše vsak udeleženec organiziranega pohoda pri izpolnitvi prijavnice za posamezni pohod:
- Od udeležencev se pričakuje, da so psihofizično zdravi, da niso pod vplivom alkohola ali drugih psihotropnih sredstev.
- Vsi udeleženci morajo biti polnoletni, mladoletni pa morajo biti v spremstvu polnoletne osebe ali imeti s seboj potrdilo staršev ali skrbnikov, da se določenega pohoda lahko udeležijo, hkrati pa sprejeti odgovornost in soodgovornost pri organiziranem pohodu.
Omejitve pri udeležbi na organiziranih pohodih:
- Za vsak pohod veljajo zgornje omejitve, hkrati pa so posebnosti glede števila udeležencev ter starosti udeležencev napisane pri vsakem pohodu posebej na internetni strani ter v navodilih za pohod, ki jih prejmejo po prejeti prijavi na aktivnost.
- Podjetje Ksandarela si pridržuje pravico do dodatnih omejitev ob izrednih vremenskih razmerah.
- Podjetje Ksandarela odsvetuje udeležbo na pohodih nosečnicam in osebam z resnimi zdravstvenimi težavami ali poškodbami.
- Podjetje Ksandarela si ob slabem vremenu ali drugih izrednih okoliščinah pridržuje pravico, da kadarkoli odpove ali prekine aktivnost. Ob odpovedi pohoda naročniku povrne stroške rezervacije v skladu z določili SPP, razen če je za posamezni pohod drugače navedeno v prijavnicah (odvisno tudi ali se pohod že izvaja ipd.).
- Pristojnosti za spremembo termina pohoda zaradi slabih vremenskih razmer ima izkjlučno podjetje Ksandarela. Laična mnenja udeležencev se ne upoštevajo in niso razlog za odpoved ture.
- Podjetje Ksandarela ne odgovarja za poškodbe, nastale izven poteka organiziranega pohoda.
- Podjetje Ksandarela ne odgovarja za poškodbe, ki so nastale v nasprotju z navedenimi določili oziroma zaradi neupoštevanja navodil planinskih vodnikov podjetja Ksandarela.
- Vsi, ki imajo kakršnekoli zdravstvene težave, morajo pred začetkom pohoda o tem obvestiti planinskega vodnika podjetja Ksandarela.
- Poškodbe, ki nastanejo med pohodom, morajo biti prijavljene takoj planinskemu vodniku na pohodu. Podjetje Ksandarela ne bo upoštevalo nobenih poškodb, ki so sporočene naknadno.
- Organiziran pohod vodi izključno za to usposobljen vodnik z ustreznimi in veljavnimi licencami.
- Oprema, ki jo mora imeti udeleženec, je oprema, ki je navedena na spletni strani ali socialnih omrežjih oz. oprema, ki jo predlaga vodnik in se jo posreduje v pisni obliki prijavljenemu, če je potrebno, tudi slikovni material.
- V primeru kakršnekoli nesreče gost dovoli, da vodnik pohoda poskrbi za primerno zdravstveno oskrbo.
- Udeleženci morajo biti zdravstveno in nezgodno zavarovani.
- Udeleženci morajo biti zavarovani za primer reševanja iz gora v Sloveniji in tujini.
- Podjetje Ksandarela fotografira vse udeležence pohoda in si s tem pridržuje pravico do uporabe fotografij za marketinške namene. Fotografije, ki so zajete med izvajanjem pohoda, so last podjetja Ksandarela.
- Izjema so osebe, ki vnaprej v prijavnici označijo, da ne dovolijo uporabe fotografij. Pred začetkom pohoda o tem vodnika tudi opozorijo.
- Podjetje Ksandarela ne prevzema nobene odgovornosti za izgubljene, ukradene ali poškodovane osebne predmete.
IZJAVA O ODGOVORNOSTI:
S podpisom na oddani prijavi vsak udeleženec zagotavlja, da pri polni zavesti in odgovornosti ter brez prisile, potrjuje, da je poučen o organiziranih pohodih podjetja Ksandarela:
- da je pohod lahko fizično zahteven in jih izvaja na lastno željo;
- da pohoda ne izvaja po vplivom alkohola, drog ali drugih psihotropnih substanc;
- da pohoda ne izvaja zaradi zdravljenja po hujših telesnih poškodbah (operacije kolena, vretenc, kolka, rame, srčni operaciji…) brez predhodnega priporočila osebnega zdravnika;
- da je seznanjen z načinom izvajanja pohoda in ga bo izvajal po navodilih vodnika in po internih pravilih podjetja Ksandarela, ki jih je prebral pred podpisom te izjave ali so mu bile povedane pred in med samim pohodom;
- da zase ali za svoje varovance v primeru poškodb in njihovih posledic ne bo sam ali s tretjimi osebami uveljavljal zahtevkov proti podjetju Ksandarela ali posameznim vodnikom zaradi lastne malomarnosti in s tem povzročenih poškodb na sebi ali drugih udeležencih.
V primeru kakršnihkoli značajskih ali zdravstvenih posebnosti, mora udeleženec to navesti v prijavnici, v nasprotnem podjetje Ksandarela smatra, da ni zdravstvenih težav.
V kolikor ima udeleženec kronične bolezni ali druge hujše oblike zdravstvenih težav, se glede organiziranega pohoda predhodno posvetuje z zdravnikom in pred izvedbo pohoda na elektronski naslov podjetja Ksandarela posreduje zdravniško potrdilo, ki bo služilo kot dovoljenje za izvedbo pohoda.
9. UPORABA PODATKOV
Vse pridobljene podatke o naročniku podjetje Ksandarela varuje skladno z Zakonom o varstvu osebnih podatkov (Ur. l. RS, št. 163/22 in 40/25, v nadaljevanju: ZVOP in ZInfP-1 ). Šteje se, da naročnik s potrditvijo rezervacije pristaja na uporabo teh podatkov tudi za namene statistične obdelave, raziskave trga, segmentiranja kupcev in obveščanja o ponudbi. Če naročnik tega ne želi, lahko to izjavi ob rezervaciji organiziranega pohoda ali kadarkoli pozneje.
10. REKLAMACIJE
Naročnik mora nepravilnosti oziroma pomanjkljivosti grajati na kraju samem vodniku organiziranega pohoda oziroma neposrednemu izvajalcu storitev.
Če vzroka pritožbe ni mogoče odpraviti, naročnik z neposrednim izvajalcem storitve ali z vodnikom pohoda sestavi pisno potrdilo oziroma reklamacijski zahtevek, ki ga podpišeta predstavnik ali izvajalec storitev in oškodovani naročnik. Reklamacijski zapisnik je tudi uradni dokument, da je naročnik grajal storitev na kraju samem.
Reklamacija mora biti utemeljena. Naročnik naj zato reklamaciji predloži ustrezne dokaze in/ali ustrezno potrdilo vodnika oziroma druge ustrezne osebe o dejanskem stanju, na podlagi katerega naročnik svoj zahtevek uveljavlja in če je vezano na ponudbo, ki jo prodaja podjetje Ksandarela.
Podjetje Ksandarela je dolžna prvič pisno odgovoriti naročniku v 8 dneh po prejemu pritožbe, dokončno pa v primernem roku, potrebnem za pridobitev informacij o vzroku pritožbe pri ponudniku storitve; oziroma v času, ki je potreben, da pridobi informacije od tretjih oseb skladno z 893. členom obligacijskega zakonika. Dokler podjetje Ksandarela ne izda odgovora, se naročnik odreče posredovanju pritožbe katerikoli drugi osebi ali sodnim ustanovam oziroma dajanju informacij medijem in drugim javnostim.
Podjetje Ksandarela bo reševalo samo pritožbe, kjer vzroka ni bilo mogoče odpraviti na kraju samem.
11. ZDRAVSTVENI PREDPISI
Naročnik je soodgovoren in zagotavlja podjetju Ksandarela, da nima nihče od udeležencev organiziranega pohoda pred prihodom na pohod nobenih zdravstvenih zadržkov ali omejitev za izvedbo pohoda. Naročnik se zaveda, da je pri vseh organiziranih pohodih, ki jih izvaja podjetje Ksandarela, povečan dejavnik tveganja za poškodbe in druge nevarnosti, zato v nobenem primeru organizirani pohodi niso primerni za nosečnice in osebe, ki imajo različne poškodbe hrbta ali so utrpele druge resne poškodbe ali operacije in se je potrebno pred tem posvetovati z zdravnikom. Ravno tako organizirani pohodi niso primerni za osebe s povečanim krvnim tlakom in za osebe, ki imajo težave s srcem. Vsi, ki imajo kakršnekoli zdravstvene težave, so odgovorni, da o tem podjetje Ksandarela obvestijo že ob rezervaciji; če to ni mogoče, pa najpozneje pred začetkom kakršnegakoli organiziranega pohoda.
Pogoji odpovedi iz strani naročnika zaradi bolezenskih stanj so opredeljeni v 6. točki Splošnih pogojev poslovanja.
12. AKTIVNOSTI ALI STORITVE, KJER PODJETJE KSANDARELA NI ORGANIZATOR
Kjer podjetje Ksandarela ni organizator aktivnosti ali storitve, nastopa v vlogi informatorja. V teh primerih podaja prejete informacije od organizatorja in/ali izvajalca aktivnosti ali storitve naročniku in mu pomaga pri prijavi na aktivnost ali storitev. Pogoji prijave, plačila in morebitne odpovedi aktivnosti ali storitve so skladni z veljavnimi pogoji drugega organizatorja oziroma izvajalca. Morebitno reklamacijo naročnik ureja z organizatorjem oziroma izvajalcem aktivnosti ali storitve.
13. KONČNA DOLOČILA
V vseh cenah za organizirane pohode iz ponudbe podjetja Ksandarela je že vključen davek na dodano vrednost. Cene, ki so pripravljene za individualno ponudbo že vsebujejo davek na dodano vrednost. Ob sporu med strankami je za vse spore pristojno okrajno sodišče. Ti splošni pogoji veljajo za vse ponudbe/pogodbe, sklenjene od dneva objave na spletni strani www.ksandarela.com, kjer so redno ažurirane vse spremembe.
